Withholding tax

On dividends paid by a public regulated real estate company, a withholding tax of 30% is applied (Programme Act of 25 December 2016, published in the Belgian Official Gazette of 29 December 2016).

Specific agreements for the prevention of double taxation provide for a reduction in this rate. To benefit from this reduction, the dividend-entitled shareholder must complete an official 276 DIV-AUT form and supply this to Intervest. The form can be downloaded via the Federal Public Service Finance website.

Under Belgian law, a partial/complete exemption from the withholding tax on dividends can be obtained by shareholders who satisfy specific conditions imposed by law.
